Pfizer Inc., the world’s biggest drugmaker, is in trouble with a series of patents protecting its top-selling diabetes drug, Xenical, from generic competition. The lawsuits filed in the lawsuits are all in the U. S. District Court for the District of New Jersey.
The lawsuits have been consolidated in federal court, and Pfizer’s current lawsuit is moving into federal court in New Jersey in the spring of 2021. The companies have filed suit against the U. Food and Drug Administration, the European Medicines Agency, and the European Commission over the use of the drug.
Pfizer has been accused of misleading the FDA by claiming that its drug containslist, which is a similar drug to the active ingredient in the drug. Pfizer has not responded to the lawsuits, but the companies have asked the FDA to approve the drug after the company learned that it has a patent on the drug. The FDA has granted the company permission to market Xenical in the U. S., but it is unclear if the company will be allowed to sell the drug in the U. until the end of the year.
“I’m concerned that the FDA is trying to block a generic competitor’s approval,” said Dr. Steven Nissen, a clinical associate at the University of Texas MD Anderson Cancer Center in Houston, who is leading the fight to block the use of the drug. “I don’t want to be the judge.”
The litigation is based on several key documents. They include the FDA’s letter that said the drug is not intended to be used as a treatment for type 2 diabetes but only as a preventive measure to prevent a heart attack and stroke.
The company also said the drug was not designed to be used as a “treatment” for hypertension, a type of high blood pressure that will be linked to obesity and diabetes. It did not say why the drug was used and that the FDA would not approve it.
The FDA has requested permission to market the drug in the U. until the end of the year, but Pfizer did not respond to the requests.
Nissen said he was “not surprised” by the FDA’s move. “It was my first reaction to the move,” he said. “I’m very concerned that the FDA has been trying to block a generic competitor’s approval.”
The FDA has also asked Pfizer to explain why it does not approve Xenical because the drug is not used to treat obesity and it does not target the type 2 diabetes that causes the problem.
Pfizer is also facing lawsuits against the makers of some of its diabetes drugs. They include the maker of Glucophage, which is a medication for type 2 diabetes, and a manufacturer of the generic version of Bextra, which is used to treat high blood pressure.
In a statement, Pfizer said it would “take appropriate legal measures to protect patients,” including filing a class-action lawsuit. It also said it will fight the lawsuits “and vigorously defend the company.”
The companies face a possible $10.7 million settlement in the lawsuits, which are expected to last until the end of the year.
